This Privacy Notice does not apply to personal information we process about:

 

- Our customer’s job applicants, managed through technology services we offer through one or more of Hirevue platform(s) (“Customer Candidate Data”).  This is instead governed by the contractual data processing terms we have agreed with those customers.   If you have applied for a role with a Hirevue customer and have any questions about our processing of Customer Candidate Data or wish to exercise your data protection rights in respect of your Customer Candidate Data, please contact the relevant customer to whom you have applied directly. If you need help  to contact the prospective employer to whom you applied, you can submit this form here.

- Hirevue’s own job applicants who apply for a role with Hirevue, including where our job applicants use the Hirevue platform in connection with Hirevue’s internal talent management activity.

HireVue, Inc. is a software technology service provider that helps global enterprises screen and evaluate talent at scale in the modern talent marketplace with its cloud-based, AI-enabled, end-to-end hiring technology platform. Our platform offers skills validation solutions, intelligent interviewing solutions, talent engagement tools and workflow automation.

 

II. Collection of Information

 

The personal information we collect depends on how you Interact With Us and the choices you make.  We collect information about you from different sources and in various ways when you Interact With Us, including information you provide directly, information collected automatically, and information from other sources.

 

The personal information we collect includes:

 

  1. Information you provide to us 

 

You may choose to provide us with personal information when you Interact With Us.  The types of personal information you may provide voluntarily include:

 

- Identity Data: We will collect identity information such as your name, the name of the organization you represent, your email address, postal address, and phone number. This is personal information you provide to us when you Interact With Us, such as by using Website functionality (including chatbots), filling out a contact form (for example, to register for or participate in an event, webinar, or demo; to request a demo or a sales call; or to submit an inquiry, complete a survey or provide feedback), or registering an account. 

- Demographic data. We will collect certain demographic details, such as your age, gender, job level, and functional role.  This is personal information you provide when you Interact With Us, complete a survey, fill out a contact or similar form, participate in research, provide feedback, or otherwise contact us). 

- Payment data: We will collect payment card numbers, financial account information, and other payment details.  This is personal information you provide if you make a purchase or other financial transaction when you Interact With Us. 

- Communications and recording data: When you Interact With Us, we will collect information such as the communication type, content, subject, sender, recipient and date.  If you participate in an audio or video call (including webinars), we (and our service providers on our behalf) may record these calls and online meetings (with prior notice and, when required by applicable law, consent). Similarly, if you send us email, chat, or other communications, we (and our service providers on our behalf) collect, record, and retain those communications.

- Preference data: This is personal information relating to any settings you select when you Interact With Us, including by specifying preferences on our Website, such as language or display settings, or settings relating to the frequency and format of any communications we send.

- Content and files. We may collect photos, documents, feedback, or other files you provide to us, permit us to access, or upload when you Interact with Us.

 

B. Information we collect automatically

 

When you Interact With Us, we may also collect some personal information automatically.  The types of personal information we collect automatically may include:

 

- Device data:  This is information relating to the device (such as your computer or mobile device) you use, such as your IP address, browser type, internet service provider, and resources viewed (e.g. Website pages), and operating system. 

- Geolocation data. Depending on your device, browser, and app settings, we may collect broad geolocation data (e.g. country or city level location).

- Usage data. We may automatically log certain activity, including the URL of the website which redirected you to us or to our Website, pages you viewed, how long you spent on a page, access times, and other details about your access to, use of, and actions on our Website.

- Information we create or generate. We may infer new information about you from other data we collect, including using automated means to generate information about your likely preferences or other characteristics. For example, we may infer your general geographic location (e.g. country or city level location) based on your IP address.

C. Information we collect from other sources 

 

In some cases, we may collect personal information about you from other sources, including from providers from whom we purchase business contact information, vendors we engage to collect personal information on our behalf, and from publicly available sources, business partners, event organisers, and professional networking sites. 

 

In general, the personal information we collect from these providers will be identity data and demographic data (i.e. as described above under the sub-heading “Information you provide voluntarily”) but may also include approximate location data to determine the state and/or country where you reside or are located.

 

D. Your ability to control information collection

When you are asked to provide personal information, you may decline. You may also use web browser or operating system controls to prevent certain types of automatic data collection. 

However, if you choose not to provide or allow information that is necessary to Interact With Us, the services or features you wish to access, including our Website, may not be available or fully functional. 

 

III. Use of Information

 

We use the personal information we collect about you for the following reasons: 

 

- To provide the services and features you wish to access when you Interact With Us: We will use your personal information to operate, maintain, enhance, support, troubleshoot, and provide our services and features when you Interact With Us, including to provide our Website, to maintain any account you have with us, and to process any orders you place.  

- To generate analytics: We will use your personal information to generate analytics for the purpose of better understanding how our visitors and customers Interact With Us, including when they visit our Website, so that we may continually improve our offering. 

- To Conduct Research and Development: We also use information we collect about your interaction with product demos (such as demos you access, share, and view with others) , industry white papers and other research papers you may download to understand your product interests and provide you with more relevant information and for other market research activities. 

- To communicate with you: We will use your personal information to communicate with you regarding your account or support related inquiries, including via email, telephone, video, or online chat tools.  Additionally, if you participate in a sales call, online meeting or product demo with Hirevue, we may record sales phone calls and online meetings (including audio and video content where applicable) for training, quality assurance, and administration purposes. This includes analyzing the content of such communications and online meetings using AI-powered tools to gain better insights into our interactions with our customers and customer prospects (subject to our notice and choice obligations under applicable law). 

- To deliver advertising and send marketing.  We may use your personal information to send you marketing communications (including news, promotions, offers and market surveys) and provide you with online advertising in accordance with any preferences you have expressed.  

- To maintain security.  We may use your personal information to maintain the security of any services and features we provide you when you Interact With Us, including the security of our Website (for example, to detect and prevent fraudulent behaviour, violations of our terms of service, or similar).  

- To manage relationships and business operations: We will use your personal information to operate our business, including for billing, accounting, improving our internal operations. 

- To comply with legal requirements.  We will use your personal information to comply with the laws and regulations to which we are subject (for example, legal requirements to report to tax authorities, disclose information to law enforcement authorities, or similar).

We may disclose your personal information to the following categories of recipients:

 

- To our group companies:  We disclose personal information with other Hirevue group companies where this is necessary for the purposes described above.  Hirevue group companies will at all times protect your personal information in accordance with this Privacy Notice.  

- To our service providers: We disclose personal information with service providers who provide services that are related to the services and features you request when you Interact With Us (for example, hosting providers, marketing and analytics providers, financial services and payment providers, communication providers (including our videoconferencing and online chat providers), IT providers, delivery partners, insurers and professional advisers).

- To competent authorities: We use and disclose personal information where we believe it is necessary to exercise, establish or defend legal claims, to protect the vital interests of any person, or to comply with an order or request from any competent court, regulator, law enforcement agency or government authority.

- To parties in a corporate transaction or proceeding: We may disclose personal information to the parties involved in (and the agents and advisers assisting with) any proposed corporate transaction or proceeding involving our business, such as a merger, financing, acquisition, bankruptcy, dissolution, transfer, divestiture, or sale of all or a portion of our assets.

- Advertising providers. We may disclose personal information collected when you Interact With Us, including by visiting our Website, to our online advertising providers including identifiers and device information (such as cookie IDs, device IDs, and IP address), geolocation data, usage data, and inferences based on and associated with that data, as described in our Cookie Statement. Our advertising providers may combine this data across multiple sites for their own purpose and others.

- To any other third party: We will only transfer your personal information to other third parties with your consent or where we are required or permitted by law to do so.

 

V. International Transfers

 

Hirevue is located in the United States, but we, our group companies and our service providers operate in various countries around the world.  For these reasons, when you Interact With Us, including by visiting our Website, your personal information may be transferred to countries other than the country in which you reside.  Hirevue will take all necessary measures to ensure that your personal information is protected in accordance with this Privacy Notice and that any such transfers are lawful. 

 

Some countries may have specific requirements that apply when we transfer personal information internationally.  Where this is the case, the requirements that apply and measures we take to comply with those requirements (where applicable) are described further under Section XII in the relevant “Additional Information for Individuals in Specific Jurisdictions” heading below.

- to not be subject to wholly automated decisions if these have legal effects on you or similarly significantly affect you, and

- if our processing is based on your consent, to withdraw your consent to our processing (although this will not affect the lawfulness of our processing prior to your withdrawal).

VIII. Data Retention

 

We store the personal information we collect for as long as is necessary for the purpose for which it was collected (for example, as long as is necessary to provide you with the services and features you request when you Interact With Us) or as otherwise necessary to comply with applicable legal requirements.

 

IX. Children 

 

Neither our Website nor any of the services or features we provide when you Interact With Us are intended for or advertised to children under 16. We do not knowingly or intentionally collect information about children under 16.

3.  EEA/UK legal basis

 

We will ordinarily collect and use your personal information only where (i) we have your consent (which will be apparent from the context, because we will ask for you consent when you provide your personal information); (ii) it is necessary to perform a contract with you (for example, we must process your payments data in order to fulfil any order you place with us), in which case we will be unable to fulfil our contract with you if you do not provide necessary information; (iii) the use is within our legitimate interests and not adverse to your rights and freedoms (for example, to send you marketing communications, provided this is consistent with your communications preferences); or (iv) it is necessary for compliance with a legal obligation.  

 

As we may rely on different legal bases for each of the different categories of personal information we process and the purposes for which we process them, please contact us if you would like further information about the specific legal basis relied upon in any particular context.

 

4.  Supplemental international transfers disclosures

 

If Hirevue transfers your personal information to a country outside of the EEA (for EEA residents), the UK (for UK residents) or Switzerland (for Swiss residents), it will ensure that any such transfers are compliant with EU and UK data protection law, as applicable.

  

In practice, this means that Hirevue will only transfer your personal information to a non-EEA or non-UK recipient where: (i) the recipient is located in a country that the European Commission has decided is adequate to receive personal information from the EEA, the UK Secretary of State has decided is adequate to receive personal information from the UK, or the Swiss Federal Data Protection and Information Commissioner has decided is adequate to receive personal information from Switzerland (as applicable); (ii) the recipient has signed appropriate contractual terms with Hirevue that incorporate the European Commission’s Standard Contractual Clauses or the UK Information Commissioner’s International Data Transfer Agreement or International Data Transfer Addendum (as applicable); or (iii) a data transfer derogation applies (for example, where you have consented to the transfer of your personal information). 

 

For transfers from the EU, UK and Switzerland to the United States, Hirevue complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. 5. Right to contact local authorities.  

You have the right to complain to your local data protection authority about our use of your personal information.  However, while you are not required to do so, we ask that you contact us first to give us the opportunity to address your concerns directly before speaking with your data protection authority.

 

B.  Additional information for individuals in California

Your California privacy rights

Under California Civil Code section 1798.83, also known as the “Shine the Light” law, California residents who have provided personal information to a business with which the individual has established a business relationship for personal, family, or household purposes (“California Customers”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. California Customers may request further information about our compliance with this law by emailing privacy@hirevue.com. Please note that businesses are required to respond to one request per California Customer each year and may not be required to respond to requests made by means other than through the designated email address.  Please be aware that we do not disclose personal information to any third parties for their direct marketing purposes as defined by this law.

 

If you are a California resident and the processing of personal information about you is subject to the California Consumer Privacy Act (CCPA), you have certain rights with respect to that information:

 

- Right to Know – You have a right to request that we disclose to you the personal information we have collected, used, disclosed, and sold about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom HireVue discloses personal information, and the specific pieces of personal information HireVue has collected about you. Note that we have provided much of this information in this privacy statement. Please review the section below titled “Exercising Your Privacy and Data Protection Rights” for more information on submitting a “right to know” request.

- Right to Delete – You have the right to request that we delete personal information we have collected about you, subject to certain exceptions. Please review the section below titled “Exercising Your Privacy and Data Protection Rights” for more information on submitting a “right to delete” request.

- Right to Correct – You have the right to request that we correct inaccurate personal information we have collected about you, subject to certain exceptions. Please review the section below titled “Exercising Your Privacy and Data Protection Rights” for more information on submitting a “right to correct” request.

- Right to Opt Out of Sale or Sharing – You have a right to opt-out from future “sales” or “sharing” of personal information as those terms are defined by the CCPA.

Note that the CCPA defines “sell,” “share,” and “personal information” very broadly, and some of our data disclosures described in this Privacy Notice may be considered a “sale” or “sharing” under those definitions. In particular, we let advertising providers collect identifiers (IP addresses, cookie IDs, and mobile IDs), usage data (browsing, clicks, app usage), and approximate geolocation data through our sites and apps when you use our online services, but do not “sell” or “share” any other types of personal information. If you do not wish for us or our providers to “sell” or “share” personal information relating to your Website visits for advertising purposes, you can manage your choices by using controls described in the Cookie Statement. If you opt-out using these choices, we will not disclose or make available such personal information in ways that are considered a “sale” or “sharing” under the CCPA. However, we will continue to make available to our providers (acting as our service providers) some personal information to help us perform advertising-related functions. Further, using these choices will not opt you out of the use of previously “sold” or “shared” personal information or stop all interest-based advertising. 

We do not knowingly sell or share the personal information of minors under 16 years of age. 

- Right to Limit Use and Disclosure of Sensitive Personal Information. You have a right to limit our use of sensitive personal information for any purposes other than to provide the Website, Interactions, or Services you request or as otherwise permitted by law.

Note that we do not use sensitive personal information for any such additional purposes.  

- Right to Notice. You have a right to receive notice of our personal information collection, use, sale and sharing, retention, and disclosure practices at or before collection of personal information. 

- Right to Non-Discrimination. You have a right to not be discriminated against for exercising these rights set out in the CCPA. 

- Right to Designate an Agent. You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting a request from an agent to know, delete, or correct personal information, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.

Exercising Your California Privacy and Data Protection Rights

To provide, correct, or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. We will verify your request by asking you to send it from the email address associated with your account or requiring you to provide information necessary to verify your account to privacy@hirevue.com. For some types of personal information we may have, such as unauthenticated web browsing data, there is no reasonable method by which we can verify your identity as the person to whom that data relates.
